MLS/IDX data displayed on this Site is copyrighted and provided under license/authorization, including pursuant to NWMLS policies and the NWMLS Data Use Policy. Republication of other members’ listings may occur through Internet Data Exchange (“IDX”) display as permitted under NWMLS rules/policies, subject to required permissions (including owner approval for internet publication).
This notice does not modify or expand any limited IDX display license or permissions.

2) How to Submit a DMCA Takedown Notice
To help us process your request, your DMCA takedown notice must be a written communication that includes all of the following:
- Your physical or electronic signature (typing your full legal name is acceptable as an electronic signature).
- Identification of the copyrighted work you claim has been infringed (or a representative list if multiple works are involved).
- Identification of the material on this Site you claim is infringing, with information sufficient for us to locate it.
- Please include the exact URL(s) where the material appears.
- Your contact information, including your name, mailing address, telephone number, and email address.
- A statement that you have a good-faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in your notice is accurate, and under penalty of perjury, that you are the copyright owner or authorized to act on the owner’s behalf.
Incomplete notices may delay processing or may not be actionable.
3) What We Will Do After Receiving a Complete Notice
Upon receipt of a complete DMCA takedown notice, we will:
- Review the notice for completeness and clarity;
- Remove or disable access to the specific material identified;
- Notify the person or entity associated with the posting/submission of the material that it has been removed or disabled; and
- Coordinate with our IDX technology provider as needed to address the display source.
4) Counter-Notification (If You Believe Content Was Removed in Error)
If content was removed or disabled due to a DMCA takedown notice and you believe the removal was mistaken or that you have authorization to use the material, you may submit a written counter-notification to the Designated Agent. A valid counter-notification must include:
- Your physical or electronic signature.
- Identification of the material removed or disabled and the location (URL) where it appeared before removal.
- A statement under penalty of perjury that you have a good-faith belief the material was removed or disabled due to mistake or misidentification.
- Your name, address, telephone number, and email address.
- A statement that you consent to the jurisdiction of the United States District Court for the Western District of Washington, and will accept service of process from the person who submitted the original notice (or their agent).
5) Repeat Infringer Policy (17 U.S.C. § 512(i))
AFHMarketplace.com has adopted and reasonably implemented a policy of terminating or disabling access, in appropriate circumstances and at our sole discretion, for users or account holders who are determined to be repeat infringers.
6) Misrepresentations (17 U.S.C. § 512(f))
Under the DMCA, any person who knowingly makes material misrepresentations in a notice or counter-notice may be liable for damages, including costs and attorneys’ fees.
